Terms of sale
These terms apply to quotations and sales of three-wheel motorcycles and related goods by Daqiang Machinery Trading Co., Ltd. (export brand TRIVARO). Where a signed contract or proforma invoice states different terms, that document prevails. Questions: [email protected].
Quotations
- Quotations are prepared per model, per configuration and per destination. The specification listed in the quotation (engine or motor, body type, payload, tyres, options) forms part of the agreement.
- Because freight and material costs change, a quotation is valid for the period stated on it; if no period is stated, ask us to reconfirm before you rely on it.
Order and payment
- An order is confirmed when we have accepted it in writing and received the payment stated in the proforma invoice.
- Payment method, currency, deposit and balance schedule are always stated in the proforma invoice for your order.
Production and delivery
- Production time is confirmed per order and depends on the configuration. Customised units take longer than stock configurations.
- Delivery terms (for example FOB or CIF) and the named port are stated in the quotation. Risk passes according to the agreed Incoterm.
- Container loading figures quoted for a model are indicative: the exact number of units per container depends on the body configuration and packing.
Inspection
You are welcome to inspect your units before shipment, or to appoint an inspector. We can supply photographs and video of the finished units on request.
Warranty
Warranty scope and duration are stated in the quotation or contract for your order. Wear parts and damage caused by misuse, overloading or unauthorised modification are outside warranty. Spare parts can be shipped with the order or afterwards.
Certification and market requirements
It is the buyer’s responsibility to confirm which approvals their market requires. We will tell you what we can supply for the model you select and will document it in the contract; we do not warrant that a given model is homologated in a market unless we have confirmed this in writing for your order.
Force majeure and disputes
Neither party is liable for delay caused by events beyond its reasonable control. Disputes are resolved by negotiation in the first instance, and otherwise according to the governing law and jurisdiction stated in the contract for your order.
